General Terms and Conditions (AGB) of GRANULAR Production House

1. Scope

These General Terms and Conditions (AGB) apply to all services provided by GRANULAR Production House (referred to as "we," "us," or "our") to clients (referred to as "you" or "client"). By engaging with us, you accept these terms.
2. Services
We provide creative storytelling services, including but not limited to video production, photography, design, writing, and consulting services. All services will be detailed in a specific project agreement, which may include timelines, deliverables, and specific terms.
3. Formation of Contract
A contract is formed once both parties have signed a project agreement or when the client accepts a written offer. Any modifications must be agreed upon in writing.
4. Pricing
Our pricing is customized per project and will be specified in the project agreement or written offer. Prices exclude VAT unless otherwise stated. Additional costs (e.g., travel, materials) will be discussed in advance and may be invoiced separately.
5. Payment Terms
Invoices are payable within 14 days unless otherwise specified in the project agreement. Late payments may incur interest charges in accordance with Austrian commercial law. If payment is delayed, we reserve the right to pause or discontinue the project until payments are up to date.
6. Rights of Use and Copyright
Upon full payment, you receive the agreed-upon usage rights for the final deliverables. All other rights, including copyright, remain with GRANULAR unless explicitly transferred in writing.
7. Changes to the Project Scope
Any modifications to the project scope, deliverables, or timelines must be mutually agreed upon. Additional costs arising from changes requested by the client will be billed accordingly.
8. Liability
We are liable only for damages caused by intentional or grossly negligent conduct. Liability for slight negligence is excluded to the extent permitted by law. We are not responsible for indirect damages, lost profits, or any damages arising from third-party involvement unless explicitly agreed upon.
9. Cancellation and Refunds
If a project is canceled by the client after a contract is signed, we may charge for work already completed and any expenses incurred. Refunds are not provided once the project has reached a specified milestone or is in its final stages.
10. Confidentiality
Both parties agree to keep all confidential information received from the other party private. This obligation continues even after the end of the contract.

We handle personal data in compliance with the GDPR and Austrian data protection laws. Please refer to our Privacy Policy for more details.
12. Governing Law and Jurisdiction
These terms and any contracts arising from them are governed by Austrian law. The competent court in Vienna will have exclusive jurisdiction for any disputes arising out of or in connection with this contract.
13. Severability
If any provision of these AGB is or becomes invalid, the remaining provisions remain unaffected. The invalid provision will be replaced with a legally permissible provision that comes closest to the intended purpose.
